1. Agreement to Terms

By accessing or using WholePath (familywholepath.innovate-change-leap.com), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use our service.

These terms constitute a legally binding agreement between you and Innovate Change Leap ("we," "us," or "our").

2. Service Description

WholePath is a digital family wellbeing assessment platform that provides:

• Comprehensive 32-question assessment across 5 wellbeing dimensions
• AI-powered personalized insights and recommendations
• Professional PDF reports delivered via email and WhatsApp
• Actionable 7, 14, and 30-day improvement plans
• Progress tracking over time (for users who complete multiple assessments)

3. User Eligibility

• You must be at least 18 years old to use WholePath
• You must provide accurate and complete registration information
• You are responsible for maintaining the confidentiality of your account credentials
• You agree not to share your account with others

4. Payment Terms

4.1 Pricing

WholePath operates on a pay-per-assessment model. Each assessment costs R25 (ZAR).

4.2 Payment Processing

• Payments are processed securely through PayFast, a PCI-compliant payment gateway
• We do not store your credit card or banking information
• Payment must be completed before accessing the assessment

4.3 Assessment Credits

• Each R25 payment grants you 1 assessment credit
• One credit allows you to complete one full assessment
• Credits are consumed upon assessment completion
• You retain lifetime access to YOUR completed assessment results
• Re-assessment requires purchasing a new credit

4.4 No Refund Policy

Due to the digital nature of our service and instant delivery of assessment results, we do not offer refunds under any circumstances once payment is processed.

Exceptions (Technical Errors Only):

• Duplicate charges due to payment processing errors
• Payment successful but assessment credit not received due to system failure

NOT Eligible for Refunds:

• ❌ Assessment already completed (results generated and delivered)
• ❌ Change of mind after purchase
• ❌ Dissatisfaction with results or recommendations
• ❌ Claim that information was already known
• ❌ Any subjective reasons related to content or quality

Before You Pay:

• Review the How It Works page to understand what you'll receive
• The R25 payment grants ONE assessment with full results
• Results are delivered instantly and cannot be refunded once generated
• By completing payment, you acknowledge and accept this no-refund policy

For legitimate technical issues only, contact us at [email protected] within 48 hours of payment with proof of the technical error.

5. Acceptable Use

You agree NOT to:

• Use the service for any illegal or unauthorized purpose
• Attempt to gain unauthorized access to our systems
• Share or resell your account access
• Manipulate or falsify assessment responses
• Reverse engineer or copy our proprietary assessment framework
• Use automated tools (bots, scrapers) to access the service
• Harass, abuse, or harm others through our platform

6. Intellectual Property

All content, features, and functionality of WholePath (including but not limited to assessment questions, scoring algorithms, reports, graphics, and logos) are the exclusive property of Innovate Change Leap and are protected by copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works without our express written permission.

7. Disclaimer of Warranties

Our service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied. We do not guarantee:

• That our service will be uninterrupted, timely, secure, or error-free
• The accuracy or reliability of assessment results
• That defects will be corrected
• Specific outcomes from following our recommendations

8. Limitation of Liability

To the maximum extent permitted by South African law, Innovate Change Leap shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of WholePath, including but not limited to:

• Personal injury or emotional distress
• Loss of profits or data
• Service interruptions
• Reliance on assessment results

Our total liability shall not exceed the amount you paid for the assessment (R25).

9. Termination

We reserve the right to suspend or terminate your account at any time for:

• Violation of these Terms of Service
• Fraudulent or illegal activity
• Abuse of our service or staff
• Non-payment

Upon termination, your right to use the service will immediately cease, though you may retain access to previously completed assessment results.

10. Changes to Terms

We may update these Terms of Service from time to time. Material changes will be communicated via email or prominent notice on our website. Continued use of WholePath after changes constitutes acceptance of the updated terms.

11. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of South Africa.

12. Severability

If any provision of these Terms of Service is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
